Abstract

This article explored to establish the intellectual rights of the missing and absent people in order to regulate such these rights, especially they are not regulated in the Iraqi copyright law  -Nu 3- 1971 and in the patent and Industrial Models Law -Nu 65-  1970, not even in the Minors Care Law -Nu 78- 1980, and all this was the motivation to make the opportunity available again to the missing author and inventor to enjoy intellectual rights in general and provide the legal protection for them, according to new mechanisms and methods that have been used to establish these provisions, taking into account the provisions of the law related to those rights and the conditions for establishing them.
